Types of Traffic Violations in Benton County
Traffic violations in Benton County range from minor equipment issues to serious criminal offenses. The District Court handles civil traffic violations, traffic-related misdemeanors, and ordinance violations. Civil violations are the less serious type and typically carry fines without jail time. Criminal traffic offenses are misdemeanors or felonies and may carry imprisonment.
Moving violations are the most common category of traffic ticket records in Benton County. These occur while the vehicle is in motion: speeding, following too closely, running traffic signals, passing a stopped school bus, reckless driving, driving with a suspended or revoked license, and failure to yield. The court record shows the specific statute, the facts of the stop, and how the case was resolved. Non-moving violations cover registration, equipment, and parking issues and generate a separate case record.
Benton County's rapid growth in recent years has brought higher traffic volumes along Highway 71B, I-49, and other major corridors, which means more traffic enforcement activity and more citation records filed with the District Court each year. The Arkansas Circuit Courts handle felony traffic cases like vehicular homicide or felony DWI when those cases exceed District Court jurisdiction.
Traffic Violation Penalties in Benton County
Arkansas Code § 27-50-306 authorizes additional penalties after a moving traffic violation conviction. The Benton County District Court can suspend your license for up to one year, grant a conditional driving permit with restrictions, require attendance at a driver's training school, or order you to retake the driver's test. The court can also require proof of adequate vision or hearing before you can drive again. These consequences come on top of the fine listed on the ticket.
Benton County District Court also offers defensive driving programs for eligible traffic offenders. Check with the court whether you qualify. Completing a defensive driving program may reduce or remove the violation from your record, depending on the court's rules. If a person under 18 was a passenger during a speeding offense of more than 20 mph over the limit or during reckless driving, the court adds a five-dollar fine that goes to the Arkansas Children's Advocacy Center Fund.
Note: Call the Benton County District Court before your court date to ask about defensive driving programs, payment plans, or other options that might apply to your case.
Driving Records vs Benton County Court Records
A traffic ticket record and a driving record are separate documents kept by different agencies. The traffic ticket record is the court case file at the District Court in Benton County. A driving record shows your full license history, violations, suspensions, and points on your license, and it is kept by the Arkansas Department of Finance and Administration, Office of Driver Services.
You can obtain your own driving record through the state's MyDMV online service. Fees run between $8.50 and $13 for uncertified or limited records. Certified records and CDL records cost a bit more. Under Arkansas Code § 27-50-906, access to another person's driving record is restricted to courts, law enforcement, authorized employers, and insurance carriers. Use CourtConnect for the court case side. Use DFA for your personal driving history.
